1. GreenDust Protection Plan (GPP) means this Protection Plan, which you have purchased to cover the product described on the proof of purchase.

 

2. GPP COVERAGE PLAN

GreenDust Protection Plan (GPP) has a term of more than one year from the date of purchase and overlaps with the term of the manufacturer’s warranty, look first to the manufacturer’s warranty for coverage. GPP excludes coverage for any loss covered by the manufacturer warranty, but may nevertheless provide benefits in addition to those provided by the manufacturer’s warranty.

 

·         GPP covers first year of Accidental Damage or Liquid Damage.

·         GPP extends warranty of your product by 1 or 2 year from the date of expiry of manufacturer’s warranty.

·         GPP can be purchased at the time of purchase of product

·         GPP will be taken up for a maximum period of two years.

·         Registration & Activation of product is required within 7 days of purchase of GPP.

·         Coverage starts only after successful registration of product.

 

3. WHAT IS COVERED

 

A.      In case of Accidental Damage & Liquid Damage

·         Period of Coverage: 0 to 12 months from the date of purchase after registration of product.

·         Coverage: Accidental Damage (including Fire & Allied Perils, Riot, Strike and Malicious Damage, Act of God perils) +Water/Liquid Damage.

·         Policy Excess to be deducted for each and every loss as per policy @ Rs 250 per claim.

·         Claim restrictions to a maximum of 2 claims.

·         Territorial Limits, Law & Jurisdiction: India.

·         Total Loss - Market value or covered value whichever is less. covered value to be arrived at by applying the following depreciation schedule excluding excess:        

Upto 90 Days           10%                 

91 to 180 Days        20%                  

181 to 270 Days      25%                  

271 to 365 Days      30%  

 

·         Partial Loss - Maximum liability shall be cost of repair and/or replacement, subject to policy excess. If the repair cost or maximum liability at the time of loss exceeds the total loss settlement, GreenDust shall settle the claim on total loss basis under BER (Beyond Economic Repair).

 

B.      In case of Extended Warranty

·         Visits, inspection and labor charges.

·         One wet and dry service per year (In case of Air Conditioners only)

·         All functional parts (mechanical / electro mechanical ) such as compressor, evaporator, condenser, thermostat, relay, fan motor, timer, pcb, heater, air damper, temperature sensors,  refrigerant charging (to a maximum of two charging a year), drier, capillary tube, magnetron, micro switches, switch membrane, high voltage transformer, low voltage transformer, diode, capacitors, wiring harness, wash & spin motor, gearbox, clutch assembly, drum, inner tube, bellows, bearings, lip switch and seal, drain motor, pump, electrical valves, buzzer, suspension, remote, chassis,  tuner, picture tube, LCD module, PDP module, SMPS, FPD, gun, speakers and capacitors.

 

4. REPLACEMENT OPTION

If your product cannot be repaired, we will either replace your product or refund an equivalent amount at our sole discretion, not to exceed the LIMIT OF LIABILITY. Such replacement or reimbursement will fulfill this GPP and will cancel and discharge all further obligations under this Protection Plan. You will be required to return your defective product along with all accessories as a condition for receiving a replacement product or reimbursement. If specified to mail in your product, you are responsible for packing the product in the original or comparable packaging to prevent further damage during shipping. Replacement will be with a product of comparable type, quality and functionality, transportation charges in case of delivery of replacement will be borne by the customer and pick up cost of the defective product will be borne by GreenDust

 

5. PARTS NON-AVAILABILITY

If replacement parts necessary for repair become unavailable during the GPP term, we will either replace your product or refund an equivalent amount at our sole discretion, not to exceed the LIMIT OF LIABILITY. Such replacement or reimbursement will fulfill this GPP and will cancel and discharge all further obligations under this protection plan. Neither we nor the retailer will be liable for any damages as a result of the unavailability of replacement parts.

 

6. NO-LEMON POLICY

If your GPP has a term of more than one year from the date of purchase and your product fails three times due to the same part(s) failure during the GPP term and after expiration of the manufacturer’s warranty period, and a fourth repair for the same problem occurs, as determined by us, within any twelve (12) month period, If replacement parts necessary for repair become unavailable during the GPP term, we will either replace your product or refund an equivalent amount at our sole discretion, not to exceed the LIMIT OF LIABILITY. Such replacement or reimbursement will fulfill this GPP and will cancel and discharge all further obligations under this protection plan.

 

7. LIMIT OF LIABILITY

The total amount that we will pay for repairs or replacement made in connection with all claims that you make pursuant to this GPP shall not exceed the coverage amount. In the event that we make payments for repairs or replacements, which in the aggregate, are equal to the coverage amount, or if we provide cash settlement reflecting the replacement cost of a new item of equal features and functionality, then we will have no further obligations under this Protection Plan.

 

We shall not be liable for any incidental or consequential damages, including but not limited to, property damage, lost time, or lost data resulting from the failure of any product or equipment or from delays in service of the inability to render services.

 

8.  ACCIDENTAL DAMAGE COVERAGE

Accidental damage coverage will cover your product for accidental damage as a result of handling, drops and externally spilled liquid. It augments your Protection Plan by providing additional protection for damage from drops, spills and liquid damage associated with the handling and use of your product.

ADLD does not provide protection against theft, loss, reckless, or abusive conduct associated with handling and use of the product, cosmetic damage and/or other damage that does not affect unit functionality, or damage caused during shipment between you and our service providers.

 

9. COMPUTER PRODUCTS

We will provide technical assistance and troubleshooting for the operation of your product. Call GreenDust at 011-66489200 If you need service provision for technical assistance. Software technical support will be limited to the proper operation of the approved operating systems and pre-installed application software programs. Software support will at no time mean tutorial assistance. This Protection Plan does not cover customer-installed software.

 

10.  MOBILE PRODUCTS

This Protection Plan provides coverage for parts and labor costs to repair or replace your product after manufacturer warranty expires where the problem is the result of operational failure caused by normal wear and tear.

 

 

 

 

11. WHAT TO DO IF PRODUCT REQUIRES SERVICE:

 

Ø  Customer informs about the issue within 48 hours either through an email at gpp@greendust.com or through call at 011-66489200.

Ø  GreenDust customer care team is available from 9 am till 7 pm, seven (7) days a week*

Ø  GreenDust customer care will register your complaint and will give you complaint no. for future reference.

Ø  GreenDust will direct you to a nearest manufacturer’s authorized service center.

Ø  Download claim form, estimate format and discharge form from www.greendust.com/gpp

Ø  In case of Mobile, Laptop, Camera and Tablet take it to a manufacturer’s authorized service center.

Ø  Procure estimate in prescribed format from manufacturer’s authorized service center.

Ø  In case of Refrigerator, Washing Machine, Microwave, AC, LED/LCD & CTV contact manufacturer’s authorized service center, get your product inspected by service engineer, take estimate and service report.

Ø  Service center or service engineer will certify if it is ADLD case then send the soft copies (claim form, repair estimate format and discharge form) at gpp@greendust.com

Ø  On approval proceed with the repair at the service center or by authorized service engineer.

Ø  Customer will pay for the repair at the service center or to the service engineer.

Ø  Customer will send all original required documents (Invoice copy of product, Invoice copy of repair, Id proof & Claim form) at registered GreenDust address.

Ø  GreenDust will reimburse to the customer after deduction as per T&C.

Ø  If your product cannot be repaired, we will either replace your product or refund an equivalent amount at our sole discretion, not to exceed the LIMIT OF LIABILITY. Such replacement or reimbursement will fulfill this GPP and will cancel and discharge all further obligations under this protection plan.

 

12. TYPES OF SERVICE AND SERVICE LOCATION

 

This Protection Plan is available on new products and only to residents of India. In-Home/On-Site Service Option - If the seller determines that your product requires in-home/on-site service, repairs will normally be performed at your residence. To receive in-home/on-site service, an adult (of legal age) must be present at the location where on-site service will be performed and the product must be easily accessible to the technician (“easily” meaning not having to remove or replace any structure, trim, mount, door, flooring, adjoining appliance, permanently affixed plumbing or piping, or external control system and removal of the product for servicing must not require more than one person for safe removal, or the use of special equipment or tools such as, but not limited to, ladders, lift trucks, or scaffolding). Periodically, your product may need to be removed from the home and repaired elsewhere but if required, transportation for taking the equipment to the service center for repairs shall be borne by the customers. Damaged caused during shifting or transporting the equipment to the service centre will not be covered under this Protection Plan. No reimbursement of expenses towards ‘carry in’ service shall be entertained. However In home/on-site service is not available for mobiles/ tablets and computers/ laptops.

 

Depot Service Option - We will either provide a mailing label to you to return your defective product for repair. Repaired products will be mailed back to you. The depot service option is the only service option for all-in-one desktops, laptops, tablets, digital cameras and cell phones.

 

Carry In Service Option - If GreenDust determines that your product requires carry-in service, repairs will be performed at an authorized service center. GreenDust will assist for pick up & the delivery of your product to the repair center for performance of the repairs. However transportation for taking the equipment to the service center for repairs shall be borne by the customers.

 

13. AVAILABILITY OF SERVICE:

Service will normally be available and rendered during the regular working hours and work week of product repair centers in your area.

 

 

 

 

 

14. TEN DAY SERVICE GUARANTEE FOR SPECIFIED PRODUCTS

We will repair or replace your product within ten (10) days from the date we receive your product or we will refund the purchase price of your protection plan. Products eligible for this service guarantee are mobile phones, laptops, & tablets.

 

15. DELAYS

For all other products covered under this Protection Plan and not listed under the TEN DAY SERVICE GUARANTEE, We will exercise reasonable efforts in providing service under this Protection Plan but will not be liable for any damages arising out of delays and will not be obligated under any guarantee to automatically replace your product or refund the purchase price of your protection plan. GreenDust will not be liable for consequential damages associated with delays. If your repair requires more than thirty (30) days to complete the expiration date of your protection plan will be extended by the repair time in excess of thirty (30) days.

 

16. PARTS

The company reserves the right to repair / replace / use reconditioned spares to make the equipment functional without compromising on the performance parameters. The replaced defective parts shall remain the property of the company.

 

17. WHAT YOU MUST DO

·         You are responsible for backing up all electronic data, computer software and personal files prior to the start of any repairs.

·         Non-technical cleaning to provide a normal operating environment as described in the manufacturer’s instruction manual for the product is your responsibility.

·         You have a duty to protect against any further damage and are required to comply with the manufacturer’s instruction manual for the product.

·         Provide us with a complete copy of proof of purchase. You can send us a digital copy through email at gpp@greendust.com and we can store it for you or you can provide such proof of purchase at time you make a claim.

·         For devices which are swapped with a new device by the original equipment manufacturer, cases wherein new IMEI number is injected & Change in Serial Number is to be notified with GreenDust within 5 days from the date of replacement or repair with documentary evidence for re registration failing which no  claim towards  ADLD & extended warranty would be entertained.

·         Provide original claim documents

 

18. PRODUCTS NOT ELIGIBLE FOR COVERAGE:

This Protection Plan does not provide any service for products used for commercial or business purposes.

 

19. TRANSFER: The GreenDust Protection Plan is not transferable in the event of resale / gift to any other person.

20. DEDUCTIBLE: A deductible may apply as per coverage terms & conditions.

 

21. WHAT IS NOT COVERED

·         War and war like operations including civil war

·         Nuclear perils or radioactive contamination

·         Any loss or damage resulting from overload, experiments or tests requiring the imposition of abnormal conditions

·         Gradually developing flaws, defects, marring or scratching of covered equipment,  wear and tear from normal use or exposure

·         Willful act or willful neglect or gross negligence

·         Any  loss  of or damage to any electronic data and/or mobile phone software /operating system, storage  media, data/records or similar intangible items.

·         Loss or damage caused by electrical or mechanical breakdown; electrical failure or short-circuit

·         Any loss or damage caused by Terrorism & Sabotage perils

·         Loss of or damage to covered equipment which has had its serial number label and/or  similar identification labels removed, defaced or altered

·         Loss outside territorial limits of India

·         Loss or damage which is covered under supplier, dealer or manufacturer’s warranty

·         All non functional parts & plastic spares such as knobs, switches, dial damper, bulb, plastic / metallic blower, fan blade, aesthetic parts, rubber parts, stabilizer’s, painted parts, data loss, software support, programs, battery, chargers, cables, and contacts are not covered under this contract.

·         Deterioration of the appearance of the product, any cosmetic part or finish defects such as paint, porcelain, glass or plastic, dents, scratches, chips, breakage, loss, rust or peeling.

·         Removal, installation & re-installation of window & split air conditioner are not covered under the contract.

·         Chemical servicing of washing machines.

·         The company shall be under no obligation to provide repair or service because of improper use, unauthorized alteration, modification, substitution of any part, defaced / altered / removed numbers (product serial number, service provider’s serial number, the Laptop accessory date code or the IMEI number) or stickers, abnormal voltage fluctuation, short circuit, explosion of battery, improper earthing, rodents damage, negligence, acts of god like floods, lightening, earthquakes etc. or causes other than ordinary or normal use. Repair services for the causes stated above, shall be executed on chargeable basis only.

·         Any breakdown, accidental damage or breakage caused by intentional act including failure to use the product in accordance to the manufacturer’s instruction, use of accessories not approved by the manufacturer or incorrect connections of signal leads or application if incorrect electrical supply, faulty software or programming not provided by the manufacturer.

·         Failure resulting from improper packaging for shipment to a service center.

·         Improper installation of components by you or an unauthorized repair center resulting in mechanical failure/ electrical failure / operational failure.

·         Physical damage to any part of the product due to any reason including  water, dust, moisture damage, dropped product, collision with another object, transportation damage, damage to the outside casing, abuse, misuse, neglect, vandalism, accidents, collapse, spillage of any kind, fire,  corrosion, sand, dirt, lightning, freezes, storms, any acts of nature, intentional or accidental damage by third parties.

·         Any viewing irregularity that may be caused by broadcast, cable or satellite abnormalities and lightning. Viewing irregularities or connection or functionality problems with Internet TV, or Internet TV related devices or services. A DVD player will be the standard testing device to determine working functionality.

·         Replacement of the component related to the above causes mentioned does not fall in the purview of the contract

·         Batteries, Lens in case of CD players & DVD players. C. Speakers, knobs & dials in case of Home theatre systems

·         Knobs, switches (piano/push/dial type) stabilizers, extension boards, main liners and bulbs.

 

 

22. Depreciation Policy:

Refund on the Invoice value will be considered after factoring depreciation for cases which are beyond repairs in the second & third year.

 

23. ARBITRATION:

Read the following arbitration provision carefully. It limits certain of your rights, including your right to obtain relief or damages through court action. Any controversy or claim arising out of or relating to this Protection Plan, or breach thereof, will be settled by binding arbitration in accordance with the commercial arbitration rules of India. Prior to filing any arbitration, we jointly agree to seek to resolve any dispute between us by mediation conducted by a mediator.

 

To begin Arbitration, either you or we must make a written demand to the other party for arbitration. The arbitration will take place before a single arbitrator. It will be administered in Delhi. The filing fees to begin and carry out arbitration will be shared equally between you and us. This does not prohibit the arbitrator from giving the winning party their fees and expenses of the arbitration.

 

YOU AGREE AND UNDERSTAND THAT this arbitration provision means that you give up your right to go to court on any claim covered by this provision. You also agree that any arbitration proceeding will only consider your claims. Claims by, or on behalf of, other individuals will not be arbitrated in any proceeding that is considering your claims.  In the event this arbitration provision is not approved by the appropriate state regulatory agency, and/or is stricken, severed, or otherwise deemed unenforceable by a court of competent jurisdiction, you and we specifically agree to waive and forever give up the right to a trial by jury. Instead, in the event any litigation arises between you and us, any such lawsuit will be tried before a judge, and a jury will not be impaneled or struck. All disputes are subject to jurisdiction of Saket court, Delhi.

24. The company reserves the right to amend the terms & conditions of the GPP at any time without assigning any reasons or without any prior notice.

25. FREE LOOK: You may reject and return this Protection Plan within three calendar days of purchase.
